LEWIS CENTER, OHIO - August 10, 2004 - Digital Storage a worldwide wholesale distributor of data storage solutions received a decision recommending preliminary injunctive relief against members of Capital Media Group by the Magistrate in the Court of Common Pleas, Delaware County, Ohio.

Joseph E. Schmansky, Magistrate, stated in his decision that “Dexxon demonstrated existence of trade secrets in its business information and data management and analysis processes.” The Court found that Dexxon’s trade secrets were indeed acquired while these Defendants were under a duty to refrain from furnishing or disclosing confidential matter or information and derived from and through persons who owed a duty to Dexxon, to maintain the secrecy of those trade secrets. “Based upon the evidence presented, Dexxon established by clear and convincing evidence the elements necessary to demonstrate its entitlement to preliminary injunctive relief. An injunction would limit or altogether foreclose the ability of Capital Media to do business with its customers and suppliers.” The Court further found “the fact that a strong market economy depends upon competitive, but fair, competition between businesses operating within a particular industry justifies this policy. Thus, an injunction in this case would serve the public interest.”
